Instant petition has been filed by the petitioner with the following prayer:

“(i) That may kindly be direct to the respondent to extend the tender for further one year from 6-12024 to 5-1-2025 in favour of the petitioner.

(ii) The may kindly be direct to the respondent to issue the work order for the period of next one year from the date 6-1-2024 to 5-1-2025 of parking palace outside of the Gandhi Nagar Railway Station, and further may kindly be direct continue the tender of petitioner for further one year as per the condition of the advertisement.

(iii) That pass any other relief, order or direction that this Hon’ble Court deems fit in the interest of equity, justice and good conscience.”

By way of filing this petition, the petitioner is seeking directions against the respondents for extension of his contract agreement executed between the parties for parking at Gandhi Nagar Railway Station.

Counsel for the petitioner submits that the petitioner was granted one year contract for the aforesaid parking w.e.f. 06.01.2023 till 05.01.2024. Counsel submits that as per Clause-6 of the contract agreement, the contract of one year can be extended for further one year, if the services of the applicant are found to be satisfactory subject to enchancement of 15% of the bid amount. Counsel submits that as per Clause-6 of the aforesaid agreement, the petitioner submitted an application for extension on 20.10.2023. Counsel submits that the said application is still lying pending for adjudication before the Jaipur Municipal Corporation, Greater Jaipur and the same has not been decided as yet. Counsel submits that since no new tender has been issued, so appropriate directions be issued to the respondents to extend the contract term of the petitioner for further one year, as the services of the petitioner are satisfactory.

In the considered opinion of this Court, since the application filed by the petitioner is lying pending before the respondents authorities and the same has not been decided on its merits, the matter is required to be examined by the respondents.

In view of above, instant writ petition stands disposed of with directions to the respondents to decide the application of the petitioner within a period 15 days form today.
