Learned counsel for the petitioner submits that against the order of suspension of licence dated 18.06.2024 passed by Office of Krishi Upaj Mandi Samiti (Fruits and Vegetables) Kota (Raj.), an appeal has already been preferred by the petitioner under Section 16 of the Agricultural Produce Market Act, before the Director, Agriculture Marketing Board. Counsel submits that neither decision has been passed on appeal nor any order on stay application has been passed by the Appellate Authority. Counsel submits that if appeal/stay application is not heard expeditiously then statutory right of appeal shall be frustrated. Counsel submits that by

impugned order, licence of the petitioner has been cancelled for five months only.

In view of above, I dispose of this writ petition with the direction to the Appellate Authority to take decision on appeal filed by the petitioner within the one month from the date of receipt of certified copy of this order. Petitioner is directed to present copy of this order within the period of ten days from today before the learned Appellate Authority.

Meanwhile, petitioner would be at liberty to press his stay application and it is expected from the Appellate Authority to pass appropriate order on the stay application filed by the petitioner along with appeal.

With the aforesaid directions, this writ petition is disposed of. Stay application also disposed of.
