Instant petition has been filed under Section 482 CrPC by the petitioner, challenging the order dated 20.10.2020 passed by Additional District and Sessions Judge No.1, Ajmer in Revision Petition No. 59/2019, dismissing the revision petition and affirming the order dated 05.07.2019 passed in Case No. 1/2017 by the Court of Sub-Divisional Magistrate, Ajmer whereby the claim of petition has been dismissed and petitioner was directed to give possession of the land in question to respondent No. 3- Mahendra Singh.

During pendency of instant petition, petitioner filed an application seeking withdrawal of the misc. petition, stating inter alia, that at this stage, petitioner does not want to assail the impugned orders, however, seeks liberty to file afresh, in case any fresh cause of action, if any subsequent change of facts accrue.

In view of above, application is allowed and instant petition stands disposed of as withdrawn with liberty as prayed for.

Stay application and other pending application(s), if any, also stand disposed of.
