By way of this criminal misc. petition under Section 528 of B.N.S.S.,2023 the accused-petitioners have approached this Court with a prayer to quash the criminal proceedings bearing No.930/2024 pending before the Court of Additional Chief Judicial Magistrate, Hindauncity District Karauli (hereinafter referred to as the 'trial Court') mainly on the ground that the parties have

entered into compromise and amicably settled their dispute and now no dispute remains between them.

The petitioners are personally present before this Court along with their counsel. The complainant/respondent No.2injured is also present along with his counsel. Both the parties submitted that the dispute between the parties have amicably settled, therefore, matter be disposed of.

Learned counsel appearing on behalf of the complainantrespondent No.2 has admitted the factum of the compromise arrived at between the parties and has no objection if the criminal proceedings pending before the trial Court in respect of the aforesaid offences, are quashed.

Heard learned counsel for the parties and perused the material available on record. 5. In view of the aforesaid and considering the fact that the parties have resolved their disputes amicably and also considering that the present case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh Vs. State of Punjab & Anr. reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. Vs. Choudhary Bhajan Lal & Ors. [AIR 1992 SC 604], the criminal proceedings in Criminal Case No.930/2024 pending before the Court of Additional Chief Judicial Magistrate, Hindauncity District Karauli be quashed and set aside.

In view of the above, this criminal misc. petition is allowed and the criminal proceedings pending before the Additional Chief

Judicial Magistrate, Hindauncity District Karauli in Criminal Case No.930/2024 are quashed and set aside. Consequence to follow.
