The present criminal misc. petition under Section 482 of Cr.P.C. has been preferred by the petitioner for quashing of the charge-sheet dated 23.11.2019 and FIR No. 159/2019, lodged at Police Station Sadar Bazar, District Jodhpur City East for the offences under Sections 380, 411 and 120-B of IPC.

Learned counsel for the petitioner while relying upon the compromise dated 22.12.2023 submits that the matter has been amicably settled between the petitioner and respondent No. 2 and therefore, it is prayed that the present criminal misc. petition may be allowed and the impugned FIR No. 159/2019 lodged at Police Station Sadar Bazar, District Jodhpur City East for the or the offences under Sections 380, 411 and 120-B of IPC and further

criminal proceedings pending before the learned Judicial Magistrate, Jodhpur in Criminal Case No. 13299/2019 (State versus Rupam Soni) and in Criminal Case No. 16/2020 (State versus Mehul Soni) pending before the learned Juvenile Justice Board may be quashed and set aside. Learned counsel for the petitioner further prays that the recovered stolen articles may be ordered to be handed over to the petitioner on Supurdaginama.

Learned Public Prosecutor opposed the prayer made by learned counsel for the petitioner. Learned counsel appearing for the complainant is not in position to dispute the fact regarding compromise being arrived at between the petitioner and the respondent No. 2. 4. In view of the above, the present criminal misc. petition is allowed on the basis of the compromise. 5. The impugned FIR No. 159/2019 lodged at Police Station Sadar Bazar, District Jodhpur City East for the offences under Sections 380, 411 and 120-B of IPC and further criminal proceedings pending before the learned Judicial Magistrate, Jodhpur in Criminal Case No. 13299/2019 (State versus Rupam Soni) and in Criminal Case No. 16/2020 (State versus Mehul Soni) pending before the learned Juvenile Justice Board are hereby quashed and set aside. In so far as the prayer made by learned counsel for the petitioner for handing him over the recovered stolen articles on Supurdaginama is concerned, it is ordered that the petitioner may move appropriate application before the learned Judicial Magistrate, Jodhpur City East in this respect. Upon filing such application, the learned Judicial Magistrate shall
