This criminal misc. petition filed by the petitioner under Section 482 CrPC against the order dated 28.09.2016 passed by the Special Judge, Dacoity Affected Area, Bharatpur in criminal revision No. 06/2015 whereby the said Court dismissed the revision petition and affirmed the order dated 16.02.2015 passed by Additional Chief Judicial Magistrate, Kumher, District Bharatpur in criminal case No. 27/2015, whereby the trial Court took cognizance against the petitioner for the offence under Section 420 IPC.
Learned counsel for the petitioner submits that the trial Court vide its order dated 16.02.2015 took cognizance against the petitioner for the offence under Section 420 IPC and summoned him. Being aggrieved thereby, the petitioner preferred the revision

petition, whereby the revisional Court vide its order dated order dated 28.09.2016 dismissed the revision petition and affirmed the order dated 16.02.2015 passed by the trial Court.
Taking into consideration the facts and circumstances of the case and more particularly in view of the fact that about 9 years have been elapsed from the date of passing the order dated 16.02.2015, the present petition filed by the petitioner is disposed of with liberty to the petitioner to take all the averments, as raised in this petition, before the trial Court.
