accused-petitioner was threatening his son to make payment of Rs. 35,000/- and his son was harassed to such extent that he committed suicide because of fear and repeated threatenings given by accused-petitioner. As per allegations of FIR, initially case under Section 306 IPC was registered. However, from the investigation report dated 13.02.2024 placed on record by the Public Prosecutor, it appears that later on offence under Section 3(2)(va) of SC/ST Act also added. Before lodging the present FIR, when the deceased Chetan consumed rat poison and was hospitalized in the night of 25.06.2020, Police recorded Parcha Bayan of deceased Chetan. In the recorded Parcha Bayan, deceased Chetan specifically stated that he consumed tablets of rat poison in the night at 12:10 A.M. on 25.06.2020, because Rinku scolded him so hard using abusive language and because of his threatenings to kill him. He stated that he indebted Rs. 2829,000/- against Rinku (petitioner-accused) and one Muna, under the money transaction in business of betting and Rinku threatened and presurrized him to repay that amount on 25.06.2020 only, else he will be killed, therefore, because of such fear, he consumed the rat poison.
