The instant bail application has been filed by petitioner under Section 439 Cr.P.C. in connection with FIR No. 426/2023 registered at Police Station Kotwali Karauli, District Karauli for the offences under Sections 420, 406, 379, 411, 120-B of the IPC.

Heard learned counsel for the petitioner as well as learned public prosecutor and perused the material available on record.

Having considered the nature of accusation against the petitioner to steal the bags of sugar and the petitioner was driver of the vehicle, co-accused namely Inamudin has been released on bail vide order dated 20.12.2023 in SB Criminal Misc. Bail application No. 15320/2023, offences are triable by the Magistrate, petitioner is in custody since 05.01.2024, the previous case of petitioner is of about 9 years back, but without

commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Shrup Khan @ Sarup @ Shahrukh S/o Kala Kha shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
