The present criminal misc. petition under Section 482 of Cr.P.C. has been preferred by the petitioner for quashing of the FIR No. 191/2023, lodged at Police Station Bekariya, District Udaipur for the offences under Sections 498-A, 406 and 323 of IPC.

Learned counsel for the petitioner submits that the present criminal misc. petition may be disposed of with liberty to the petitioner to submit the representation along with the relevant documents before the Superintendent of Police concerned and till then, he may not be arrested. Further, learned counsel for the petitioner seeks liberty to approach the competent Court of Jurisdiction, in case, any fresh cause of action arises in relation to impugned FIR.

In view of the limited prayer made by learned counsel for the petitioner, present criminal misc. petition is disposed of with liberty to the petitioner to file representation along with the relevant documents before the Superintendent of Police concerned within a period of one week. Upon filing the same, the Superintendent of Police concerned shall decide the same in accordance with law after providing appropriate opportunity of hearing to the petitioner within a period of three weeks.

Till then, the petitioner shall not be arrested in connection with FIR No. 191/2023, Police Station Bekariya, District Udaipur. 5. The petitioner is also granted liberty to approach competent Court of Jurisdiction if any new cause of action arises in relation to the impugned FIR.

Stay petition also stands disposed of accordingly.
