The instant criminal misc. petition under Section 482 Cr.P.c. has been filed by the petitioner seeking quashing of the proceedings in Criminal Appeal No.14/2015 (Omendra Singh & Anr. Vs. State of Raj.), pending before the Court of learned Session Judge, Jodhpur, District Jodhpur, for the offences under Sections 419, 420, 467, 468, 471 and 120B of the IPC.

Learned counsel for the petitioner submitted that the parties have settled their disputes and have arrived at a compromise.

Learned counsel for the petitioner has placed reliance on a decision of Hon’ble the Supreme Court in the case of Gian Singh Vs. State of Punjab & Anr. reported in (2012)10 SCC 303] .

He therefore prayed that the impugned proceedings may kindly be quashed.

Learned counsel for the complainant concurs the factum of compromise and submits that in view of the compromise, the complainant is not inclined to proceed further in the matter.

From a perusal of the order sheets present on record, this court finds that the factum of compromise between the parties has been brought to the notice of the learned appellate court as well. However, no direction allowing or declining the withdrawal of the appeal has been given by the learned appellate court.

Accordingly, the present misc. petition is disposed with a direction to the learned Sessions Judge, Jodhpur, District Jodhpur to decide the appeal number 14/2015 (Omendra Singh & Anr. Vs. State) arising out of FIR No.120/2004 lodged at P.S. Sardarpura, District Jodhpur, as expeditiously as possible within a period of two months from the date of this order, in light of the compromise arrived at between the parties.

Stay petition also stands disposed of accordingly.
