The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 01/2024 registered at Police Station Bhinay, District Kekri for the offence(s) under Sections 143, 283, 332, 353, 436, 336, 458, 307 & 427 of IPC.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the case. He further submits that the police officials were beaten. He also submits that the injuries sustained to Surendra Godara, Hariram & Pradeep were found to be simple in nature. After their medical examination, no case is made out under Section 307 of IPC against the petitioners. The petitioners Pukhraj, Kanaram, Dilkush @ Mansukh, Kalusingh Rawat and Shivraj are in judicial custody since 02.01.2024 and petitioner Duda Singh is in judicial custody since 06.01.2024 and the trial of the case may take considerable time, therefore, the benefit of grant of bail may be granted to the accused-petitioners.

Learned Public Prosecutor vehemently opposes the bail applications.

Considered the arguments advanced by the counsel for the parties and looking to fact that the injuries sustained to the injured Surendra Godara, Hariram & Pradeep were found to be simple in nature, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners Pukhraj

S/o Bhojaram Gurjar, Kanaram S/o Bhojaram Gurjar, Dilkush @ Mansukh S/o Babulal @ Nathu, Kalusingh Rawat S/o Gangaram Rawat, Shivraj S/o Kalyan and Duda Singh S/o Shir Mangla Rawat, in connection with FIR No. 01/2024 registered at Police Station Bhinay, District Kekri shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
