This anticipatory bail application has been filed by the petitioner under Section 482 of the B.N.S.S. arising out of F.I.R. No.148/2024, registered at Police Station Sunel, District Jhalawar for the offences under Sections 341, 323, 504, 308 & 34 IPC.

Learned counsel for the petitioners submits the accusedpetitioner has been falsely implicated in this case and no specific overt-act has been assigned to her. Counsel further submits that the accused-petitioner is a lady and no purpose will be served in sending her in custody. Counsel further submits that the accusedpetitioner is ready to cooperate in the investigation in future, therefore, the benefit of anticipatory bail may be granted to the her.

Learned Public Prosecutor has opposed this anticipatory bail application.

petitioner as well as learned Public Prosecutor.

Taking into consideration the fact that no specific overt-act has been assigned to the petitioner in the averments made in the FIR so also the fact that the accused-petitioner is a lady, this Court without expressing any opinion on merits and demerits of the case, deems it just and proper to extend the benefit of anticipatory bail to the petitioner.

Accordingly, this Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Sunel, District Jhalwar in F.I.R. No.148/2024 is directed that in the event of arrest of the petitioner she shall be released on bail, provided she furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-

(i) that the petitioner shall make herself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and

¶24

(iii) that the petitioner shall not leave India without previous permission of the Court.
