The instant bail application has been filed under Section 483 B.N.S.S. on behalf of the accused-petitioner. The accusedpetitioner has been arrested in connection with FIR No.0066/2024 registered at Police Station-Jaluki, District-Deeg for the offence(s) under Sections 419, 420, 467, 468, 120B of IPC and Section 66D of the I.T. Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case for offences under Sections 419, 420, 467, 468, 120B of IPC and 66-D of IT Act. The case is exclusively triable by the Magistrate. The petitioner is in custody since long and trial of the case may take considerable time. Other co-accused-Ansar S/o Suleman has already been enlarged on bail vide order dated 14.06.2024. The case of the petitioner is not distinguishable from the case of the

co-accused-petitioner, who has already been enlarged on bail, therefore, the instant bail application of the accused-petitioner may be allowed.

Per contra, learned Public Prosecutor opposes the bail application.

Heard and perused the material available on record.

Considering the fact that the petitioner is in custody since 04.07.2024 and the matter is exclusively triable by Magistrate. Trial of the case may take considerable time and there is no criminal antecedents against the accused-petitioner. Other coaccused-Ansar S/o Suleman has already been enlarged on bail, therefore, I deem it just and proper to allow the bail application of the present accused-petitioner.

Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner- Mohammad Asfak S/o Suleman in connection with FIR No.0066/2024 registered at Police Station-Jaluki, District-Deeg shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
