Petitioner has filed this bail application under Section 439 Cr.P.C., arising out of F.I.R. No.152/2024, registered with the Police Station Kotwali, Jaipur City (North) for the offences under Section 323, 341, 324, 308 & 34 of IPC.

Counsel for the petitioner submits that the petitioner has been falsely implicated in the matter. Counsel also submits that the petitioner is behind the bars since 15.05.2024 and the police after conclusion of the investigation, has submitted charge-sheet in the matter, therefore, the petitioner may be released on bail and trial of the case will take its own time.

Learned Public Prosecutor has vehemently opposed the bail application.

petitioner as well as the learned Public Prosecutor and perused the case diary.

Taking into consideration the allegations levelled against the petitioner and so also the nature of injuries and further the fact that the police after conclusion of the investigation submitted charge-sheet in the matter, this Court without expressing any opinion on the merit and demerits of the case, deems just and proper to enlarge the petitioner on bail.

This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
