Apprehending his arrest in connection with FIR No.221/2021 registered at Police Station Soorwal, District Sawai Madhopur for the offences under Sections 420, 467, 468, 471 and 120-B IPC, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.

The Court vide order dated 31.05.2024 and further order dated 09.07.2024, directed the learned Public Prosecutor to call for the report from the concerned Investigating Officer with regard to verification of the fact as stated by learned counsel for the petitioner that the petitioner has already deposited the entire loan amount taken from the Union Bank of India, Branch at Sawai Madhopur.

Learned Public Prosecutor has placed before this Court the factual report dated 10.07.2024 sent to their office by the Station House Officer, Police Station Soorwal, District Sawai Madhopur which is taken on record.

As per the factual report dated 10.07.2024, the petitioner has already deposited the complete outstanding loan amount alongwith interest i.e. Rs.8,41,000/- with the Union Bank of India and has also submitted copy of receipts alongwith the same.

Considered the allegations levelled against the petitioner and so also the fact that he has already deposited the complete due amount with the Union Bank of India, Branch at Sawai Madhopur, this Court without without expressing any opinion on the merits/demerits of the case, deems just and proper to extend the benefit of anticipatory bail application to the petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner named above in connection with FIR No.221/2021 registered at Police Station Soorwal, District Sawai Madhopur shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties in the sum of Rs.50,000/each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
