This bail application has been filed by the accused petitioner under Section 439 Cr.P.C. in connection with FIR No.258/2023 registered at Police Kanwas, District Kota Rural for the offences under Sections 3, 5, 6 & 8 of the Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Rules, 1995.

Learned counsel for the petitioner submits that the accusedpetitioner has been falsely implicated in this case and after completion of the investigation, the Police has already submitted charge-sheet in the matter. He further submits that the trial will take its own time, therefore, the accused petitioner may be released on bail.

Learned Public Prosecutor vehemently opposed the bail application.

Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material available on record.

Having considered the submissions made by learned counsel for the accused-petitioner so also the allegations levelled against him and further the fact that the Police has already submitted charge-sheet in the matter, this Court without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this second bail application is allowed and it is ordered that accused-petitioner named above in connection with the aforesaid FIR shall be released on bail provided, he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac Only) (each), together with two sureties in the sum of Rs. 50,000/(Rupees Fifty Thousand Only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
