All these bail cancellation applications have been filed with the core submission that while accepting the bail bonds and securities under Section 88 of Cr.P.C. and granting of bail, the conditions enshrined under Sub-Section (1) of Section 45 of the Prevention of Money Laundering Act, 2002 (for short ‘the PMLA’) are required to be mandatorily followed by while passing the orders impugned and the said conditions were not taken into consideration.

Learned counsel for the applicants has placed before this Court the order dated 21.08.2024 passed by the Coordinate Bench of this Court in S.B. Criminal Bail Cancellation Application No.40/2024; Directorate of Enforcement, through Special PP vs. Piyush Jain & Anr. with other connected matters, wherein, the core issue raised by the applicants hearein has been considered in similar matters and decided as under:

The Coordinate Bench of this Court has passed the order dated 21.08.2024 in case of Directorate of Enforcement vs. Piyush Jain (supra) after considering the various judgments passed by the Hon’ble Apex Court as well as of other High Courts.

Learned counsel appearing for the accused-respondents opposed the bail cancellation applications and submits that the learned Court below has passed the orders allowing the bail applications of the accused-respondents after following due process of law and following the required conditions.

This Court is in agreement with the view taken by the Coordinate Bench of this Court in case of Directorate of Enforcement vs. Piyush Jain (supra) with other connected matters wherein the bail cancellation applications were dismissed having similar facts.

Learned counsel appearing for the applicants himself has submitted the judgment passed in the case of Directorate of

Enforcement vs. Piyush Jain (supra) saying that in similar matters the Coordinate Bench has passed the order dated 21.08.2024. As a result, all these bail cancellation applications are also liable to be dismissed.
