The instant second bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The accusedpetitioner has been arrested in connection with FIR No. 32/2024 registered at Police Station Mishroli, District Jhalawar for the offence(s) under Sections 307 and 384 IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case.

Learned counsel has placed the statement of the material eye-witnesses PW-1 Anar Singh and PW-2 Dashrath Singh on record.

The same is taken on record.

Counsel further submits that there is no eminent danger from the side of the accused-petitioner to threaten the witnesses, as the material witnesses, have already been examined. It is also argued

that the accused-petitioner also filed a cross-case against the complainant party and there is old dispute between the parties. There is no gun-shot injury to the victim Dashrath Singh and no cartridges and bullets were recovered from the place of occurrence. He further submits that the accused-petitioner is in custody since 22.03.2024 and the trial of the case will take considerable time, therefore, the benefit of bail may be granted to the accused-petitioner.

Per contra, learned Additional Government Advocate opposes the bail application.

Heard and perused the material available on record.

After perusing the entire material available on record and considering the fact that the accused-petitioner is in custody since 22.03.2024 and there is no injury to the victim from the fire-arm. Therefore without commenting anything further on the merits of the case, I deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the second bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Narsingh S/o Madan Singh in connection with FIR No. 32/2024 registered at Police Station Mishroli, District Jhalawar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge.

The accused- petitioner is also directed to mark his presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court

every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
