This bail application has been filed by the accused-petitioner against the order dated 17.05.2024 passed by learned Sessions Judge, Bundi under Section 439 of the Cr.P.C. in connection with FIR No.223/2024, registered at Police Station Hindoli, District Bundi for the offences under Section 4/21 of the Mines and Minerals (Development & Regulation) Act, 1957 and under Section 379 of IPC by which the bail application of the accused-petitioner under Section 439 of Cr.P.C. has been dismissed.

Learned counsel for the accused-petitioner submitted that the accused-petitioner has falsely been implicated in this case.

Learned counsel further submitted that charges levelled against the accused-petitioner are under Section 379 of IPC and under Section 4/21 of the Mines and Minerals (Development & Regulation) Act, 1957 and the same are triable by Judicial Magistrate. Learned counsel also submitted that there is no other case pending against the accused-petitioner except a case, offences under Sections 279, 336 and 304-A of IPC.

Learned counsel for the accused-petitioner argued that the accused-petitioner was arrested on 06.05.2024 and since then, he is behind the bars and, therefore, the accused-petitioner may be granted benefit of bail.

Learned Public Prosecutor vehemently opposed this bail application.

Heard learned counsel for the accused-petitioner and learned Public Prosecutor and also perused the material available on record.

Having regard to the facts and circumstances of the case and considering the facts that offences are triable by Judicial Magistrate and the trial will take time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the petitioner.

Consequently, this bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that accused-petitioner Suresh S/o Shri Kajod, arrested in FIR No.223/2024, registered at Police Station Hindoli, District Bundi shall be released on bail; provided he furnishes personal bond in the sum of Rs.50,000/- and two

sureties of Rs.25,000/- each to the satisfaction of the trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
