This bail application has been filed by the petitioner under Section 439 Cr.P.C., arising out of F.I.R. No.258/2023, registered with the Police Station Madanganj, District Ajmer for offence under Section 392 of IPC.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is behind the bars since 27.12.2023. Counsel further submits that the offences as alleged against the petitioner is triable by the Magistrate, therefore, he may be released on bail.

Learned Public Prosecutor has opposed the bail application.

Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor and also perused the challan papers.

As per challan papers, no recovery of the articles has been made at the instance of the petitioner.

Taking into consideration the overall facts & circumstances of the case, the fact that the offences as alleged against the petitioner is triable by the Magistrate and also the fact that the petitioner is behind the bars since 27.12.2023, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court and any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
