This bail application has been filed u/S 439 Cr.P.C. by the accused petitioner in connection with FIR No. 734/2023 registered at Police Station Pratap Nagar, District Jaipur for offence under Section 379 IPC.

Heard learned counsel for the petitioner as well as the learned Public Prosecutor.

Learned counsel for the petitioner submitted that the offence alleged against the petitioner is triable by the First Class Magistrate. He further submitted that the petitioner is behind the bars since 09.03.2024 and no purpose will be served by keeping him behind the bars.

Learned Public Prosecutor vehemently opposed the bail application and submitted that there are as many as 12 other cases pending against the petitioner.

Considered the submissions made by learned counsel for the petitioner as well as the learned Public Prosecutor.

On perusal of the details about the criminal cases pending against the petitioner, it is found that maximum of them are of the year 2020.

Taking into consideration the fact that the allegations against the petitioner is triable by the First Class Magistrate and the petitioner is behind the bars since 14.06.2024, this Court, without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
