The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 569/2023 registered at Police Station Niwai, District Tonk for the offence(s) under Sections 143, 307, 323 and 341 of IPC.

Learned counsel for the petitioners submits that the accusedpetitioners have been falsely implicated in the case. Injuries sustained to injured Kedarmal were not at vital part. Petitioners is in custody since 07.01.2024 and investigation/trial of the case will

take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioners.

Learned Public Prosecutor and learned counsel appearing for the complainant have vehemently oppose the bail application and submit that petitioner Jeetram caused 15 injuries to injured Kedarmal and run over the vehicle with intention to cause his death. The other co-accused also inflicted various injuries to injured Kedarmal therefore considering the injury sustain to injured Kedarmal and specific act of the petitioners, bail application may be dismissed.

Heard and perused the material available on record. As a result of altercation between the parties, injured Kedarmal received 15 injuries. The injury Nos. 12 and 14, caused at left hand and right hand, were found to be grievous in nature. Injury No. 1, 3, 4 ,5, 6, 10 and 11 were found to be simple blunt in nature. There is no specific opinion of doctor that injuries caused to injured were dangerous to life. 5. Without commenting anything on the merit of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, this bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Jeetram S/o Lakshman, Ramray S/o Ratanlal and Danveer @ Pilot S/o Ramphool, in connection with FIR No. 569/2023 registered at Police Station Niwai, District Tonk shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court
