The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.757/2023 registered at Police Station Kotwali Alwar, District Alwar for the offence(s) under Sections 380 & 457 IPC.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is in custody since January, 2024. He further submits that the recovery of the alleged mobile was made after seven months from the date of occurrence. He further submits that the charge-sheet has already been filed against the petitioner, therefore the bail application of the petitioner may be allowed.

Learned Public Prosecutor has opposed the bail application and submitted that petitioner has been found involved in 23 other

cases, therefore, considering the criminal antecedents of the petitioner and the bail application of the petitioner may be dismissed.

Heard and perused the rejection order as well as chargesheet.

Considering the arguments advanced by the counsel for the petitioner, without commenting anything on merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Mahesh @ Maisi S/o Kishanlal in connection with FIR No.757/2023 registered at Police Station Kotwali Alwar, District Alwar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.

In addition to above, the accused-petitioner shall mark his presence at the Police Station NEB, Alwar on the First Saturday of every month between 10:00 AM to 11:00 AM during the course of trial.
