The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 41/2024 registered at Police Station Mandana, District Kota Rural for the offence(s) under Sections 8/15 of NDPS Act.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. Counsel further submits that co-accused Gorilal has already been enlarged on bail by this court vide order dated 22.04.2024 passed in SB Criminal Misc. bail application No. 4607/2024 and case of the petitioner is not distinguishable from the case of co-accused. Recovered quantity of contra band article is below commercial quantity. The accused petitioner is in custody since 21.03.2024 and the trial of

the case will take considerable time, therefore, the benefit of bail may be granted to the accused-petitioner.

Learned Public Prosecutor opposes the bail application.

Considering the arguments advanced by counsel for the parties and looking to the overall facts and circumstances of the case, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 5. Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Prahlad Ram S/o Pratapram in connection with FIR No. 41/2024 registered at Police Station Mandana, District Kota Rural shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
