This anticipatory bail application has been filed by the accused petitioner u/S 438 CRPC in connection with FIR No. 29/2024 registered at Police Station Kishanganj, District Baran for offence u/S 379 IPC and u/S 4/21 of the Mines and Minerals (Development and Regulation) Act 1957.

No one is present on behalf of the accused petitioner. However, this anticipatory bail application is pending since 30.04.2024, therefore, the same is being decided on merits.

Vide order dated 19.07.2024, the Coordinate Bench of this Court, directed the accused petitioner to appear before the Investigating Officer for interrogation.

Learned Public Prosecutor submits that under the directions of this Court, the accused petitioner has appeared before the Investigating Officer for interrogation and he has been interrogated, wherein the accused petitioner has submitted that

he was not knowing whether the alleged act of the accused petitioner is an offence.

Having considered the allegations against the accused petitioner and so also the fact that the accused petitioner has been interrogated by the Investigating Officer and taking into consideration the other material collected during investigation, this Court deems just and proper to allow the anticipatory bail of the petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner named above in connection with FIR No.29/2024 registered at Police Station Kishanganj, District Baran shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac Only) with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶25

(iii) that the petitioner shall not leave India without previous permission of the court.
