The instant bail application has been filed by petitioner under Section 439 Cr.P.C. in connection with FIR No.225/2023 registered at Police Station Atal Band, District Bharatpur for the offence(s) under Sections 452, 394, 307, 34 of the IPC and Section 9/25 Arms Act.

Heard counsel for petitioner and learned Public Prosecutor as well as perused the material available on record.

Having considered the facts that no identification parade of the accused persons has been carried out, investigation has completed and charge sheet has been filed, on the basis of CCTV footage, firearms has been observed to be opened by one Jitendra; petitioner is in custody since 04.09.2023 and the coaccused namely Monu Sharma has been released on bail after

arrest vide order dated 12.12.2023, the case of petitioner is not differentiated than that of Monu Sharma, but without commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Rajkumar S/o Punjabi shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.

However, in view of pendency of two cases against the petitioner, it is made clear that if the petitioner is found involved in similar nature of offence or would induce or threaten the prosecution witnesses, during bail granted by this Court or breach of such condition is reported or come to the notice of the Court, the same shall be a reason for the trial Court to cancel the bail, granted by this Court.
