The instant bail application has been filed by petitioner under Section 439 Cr.P.C. in connection with FIR No.225/2023 registered at Police Station Atalbandh, District Bharatpur for the offence(s) under Sections 452, 394, 307, 34 of the IPC and Section 9/25 Arms Act.

It has been submitted by counsel for the petitioner that the petitioner has not been identified by the complainant/injured, however, on the basis of CCTV footage, there is an apprehension that petitioner opened the firearm; charge sheet has been filed and petitioner is in custody since 28.08.2023, conclusion of trial will take its own time, therefore, petitioner be released on bail.

Learned Public Prosecutor has opposed the bail application.

Heard counsel for petitioner and learned Public Prosecutor as well as perused the material available on record.

Having considered contentions of counsel for petitioner as put forth hereinabove, and the facts that on the basis of CCTV footage, firearm has been observed to be opened by the petitioner on the thigh of injured, injury is not on vital part nor dangerous to life; charge sheet has been filed and the period of custody of petitioner and in such totality of facts and circumstances, but without commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Jitendra @ Jeetu S/o Shri Dhoop Singh shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.

However, in view of pendency of case against the petitioner, it is made clear that if the petitioner is found involved in similar offence, or would induce or threaten the prosecution witnesses, during bail granted by this Court or breach of such condition is reported or come to the notice of the Court, the same shall be a reason for the trial Court to cancel the bail, granted by this Court.
