The petitioner apprehended his arrest in connection with FIR No.420/2023 registered at Police Station Sikari, District Deeg for the offences under Sections 332, 353, 379 IPC and Sections 41 & 42 of the Indian Forest Act, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.

Learned counsel for the petitioner submits that the accusedpetitioner has been falsely implicated in this case by the complainant just to arrest him. Learned counsel also submits that the accused-petitioner has joined the investigation and no purpose would be served in sending the accused-petitioner in custody.

Learned Public Prosecutor opposed the anticipatory bail application and submits that during investigation the allegations levelled against the accused-petitioner have been found to be proved. He also submits that in the interrogation note of the

accused-petitioner-Jahul Khan, he has admitted that he was there alongwith the other co-accused persons at the place of incident and the interrogation report clearly speaks his involvement.

Considered the submissions made at bar and also perused the case diary as well as status report and the interrogation report also.

The allegations against the accused-petitioner alongwith with the other co-accused are of entering the Government office and created obstructions and also tried to take away the seized vehicles by force.

On consideration of the allegations against the accusedpetitioner and the evidence collected during investigation, this Court is not inclined to grant benefit of anticipatory bail to the accused-petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is dismissed.
