The present bail application has been filed by the petitioner under Section 439 Cr.P.C. in connection with FIR No.125/2021 Registered at Police Station Industrial Area, District Pali for the offence(s) under Sections 457 and 380 IPC.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 15.12.2023. Charge-sheet has been filed against the petitioner. Offence against the petitioner is triable by Magistrate. Similarly situated co-accused Ram Prashad @ Tariya has been enlarged on bail by this Court vide order dated 18.10.2021 in S. B. Criminal Miscellaneous Bail Application No.13917/2021.

Conclusion of trial may take long time. Hence, the petitioner may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the parties and taking into account the facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Balmukund S/o Heera Lal be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he will appear before the trial court on all subsequent dates of hearing and as and when called upon to do so.
