The present bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.37/2021 Registered at Police Station Karda, District Jalore for the offence(s) under Sections 147, 148, 149, 302, 452, 323, 307 and 120-B IPC (later on offence(s) under Sections 147, 148, 307, 302, 323, 324, 452 and 120-B/149 IPC were found to have been made out).

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. They are behind the bars since 09.06.2021. Charge-sheet has been filed against the petitioners. During trial, prosecution witnesses namely PW-1 Jagmalram and PW-2 Kishnaram have not supported the

prosecution story. Learned counsel for the petitioners further submits that similarly situated co-accused persons Mukesh Kumar @ Pappu Ram and Ramchandra have been enlarged on bail by the co-ordinate Bench of this Court vide order dated 18.10.2023 in S. B. Criminal Miscellaneous Bail Application Nos.12555/2023 and 11733/2023. Co-accused Ramesh Kumar has also been enlarged on bail by this Court vide order dated 04.10.2021 in S. B. Criminal Miscellaneous Bail Application No.8105/2021. Conclusion of trial may take long time. Hence, the petitioners may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the parties and taking into account the facts and circumstances of the case, without expressing any opinion on the merits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners (1) Punama Ram S/o Shri Heera Ram (2) Prakash S/o Shri Heera Ram be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they will appear before the trial court on all subsequent dates of hearing and as and when called upon to do so.
