This bail application has been filed by the petitioner under Section 439 Cr.P.C. in connection with FIR No.221/2023 registered at Police Station Phulera, District Jaipur for offence(s) under Sections 323, 341, 307, 325, 452 and 34 of IPC.

It has been submitted that the medical report of injured Radha Devi was prepared after a delay of two months and she has already been discharged from the hospital, injuries caused to injured Girdhari Lal are not on vital parts. There are no previous criminal antecedents of petitioner; another co-accused Kuldeep Kumawat has been released on bail under Section 439 Cr.P.C.; after completion of investigation, charge-sheet has been filed and conclusion of trial may take a considerable time, therefore, petitioner be released on bail.

Learned Public Prosecutor opposed the bail application.

Having heard learned counsel for petitioner as well as learned public prosecutor and perused the material available on record, considering the fact that the medical report of injured Radha Devi was prepared after a delay of two months and she has already been discharged from the hospital, injuries caused to injured Girdhari Lal are not on vital parts. There are no previous criminal antecedents of petitioner; another co-accused Kuldeep Kumawat has been released on bail under Section 439 Cr.P.C.; after completion of investigation, charge-sheet has been filed and conclusion of trial may take a considerable time, but without commenting on merits of the case, this Court deems it just and proper to release petitioner on bail.

Accordingly, the bail application is allowed and it is ordered that accused-petitioner Madan Lal S/o Nanuram shall be released on bail provided, he furnishes a personal bond in the sum of Rs.50,000/- each with two sureties of Rs.25,000/- to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
