This bail application has been filed by the petitioner under Section 439 Cr.P.C., arising out of F.I.R. No.569/2022, registered with the Police Station Bassi, District Jaipur for offence under Sections 302 & 201 of IPC.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is languishing behind the bars since 24.10.2022. Counsel further submits that there is no cogent evidence on record so as to connect the petitioner with the crime. Counsel further submits that out of total eighteen witnesses, seven witnesses have been examined so far therefore, the petitioner may be released on bail.

Learned Public Prosecutor has vehemently opposed the bail application and submits that blood-stained stone was recovered at the instance of the petitioner from the well by which he committed murder of the deceased. He further submits that trial of the case

is in progress, therefore, the petitioner does not deserve any liberty.

Considered the submissions made by learned counsel appearing for the respective parties and also perused the challan papers and also the statements of some of the witnesses recorded before the learned Trial Court.

The only evidence that has been put-forth by the prosecution so as to connect the petitioner with the alleged crime is the recovery of blood-stained stone at the instance of the petitioner from the well. The well is a public place and not in the possession of the petitioner. The recovery of the said blood-stained stone at the instance of the petitioner is doubtful.

Taking into consideration the overall facts and circumstances of the case and also the fact that the petitioner is behind the bars since 24.10.2024, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
