Learned counsel for the petitioner submits that he does not want to press the present third bail application at this stage. However, he seeks liberty to revive the prayer for bail after the statement of the Investigating Officer and balance of recovery evidence is recorded before the trial court.
Accordingly, the present bail application is dismissed as not pressed with liberty as aforesaid.
However, on the request made by learned counsel for the petitioner, the trial court is directed to explore the possibility of recording evidence of investigating officer and balance of recovery witnesses at its earliest convenience.
