The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.149/2024 registered at Police Station Kotwali Sikar, District Sikar for the offence(s) under Sections 3 and 8 of the Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act.

Learned counsel for the petitioners submit that the accusedpetitioners have falsely been implicated in this case. Counsel for

the petitioners further submits that name of the petitioners are not mentioned in the FIR, they have wrongly been involved in this case and investigation/trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed.

Learned Public Prosecutor vehemently opposes the grant of bail application.

Heard and perused impugned order dated 02.04.2024. 5. Considering the fact that name of the petitioners are not mentioned in the FIR and investigation/trial of the case may take considerable time, thus, without commenting anything on the merits of the case and, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners namely, 1. Mohd. Taslim S/o Abdul Rasheed, 2. Muslim S/o Abdul Rasheed and 3. Asalm S/o Balu Kha @ Ramjan Kha, in connection with FIR No.149/2024, registered at Police Station Kotwali Sikar, District Sikar, shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
