The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 335/2023 registered at Police Station Kotwali, District Bundi for the offence(s) under Sections 406, 420 and 120-B of IPC.

Learned counsel for the petitioner submits that the accusedpetitioner has been falsely implicated in the case. Police has already submitted the charge-sheet against the present petitioner and the other co-accused Nand Kanwar. It is also contended that co-accused Nand Kanwar has already been enlarged on regular bail by the trial court vide order dated 21.02.2024. Petitioner is in custody since 16.02.2024 and trial of the case may take considerable time and the matter is triable by Magistrate.

Therefore, the benefit of bail should be granted to the accusedpetitioner.

Learned Public Prosecutor opposes the bail application.

Considering the arguments advanced by the counsel for the parties and without commenting anything on the merit of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, this bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Guman Singh S/o Gopal Singh, in connection with FIR No. 335/202023 registered at Police Station Kotwali, District Bundi shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
