Apprehending their arrest in connection with FIR No. 310/2016 registered at Police Station Bonli, District Sawaimadhopur for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC the petitioners have preferred this anticipatory bail application under Section 438 Cr.P.C.

Learned counsel for the accused-petitioners submits that petitioners have falsely been implicated in this case. Petitioners are agriculturists. They are illiterate and have not forged any document. Main allegation of forging the document is against coaccused Surendra Yadav. It is also submitted that applicants are respected persons and appeared before the investigating officer in

pursuant to order dated 04.03.2024, therefore, their anticipatory bail may be allowed.

Learned Public Prosecutor vehemently opposed the bail application and produced the factual report. The same is taken on record. Investigating officer in factual report has clearly stated that petitioners are illiterate and they cannot sign. It is also mentioned in the factual report that Surendra Yadav has received amount from the petitioners and thereafter, he forged the documents to obtain money under the scheme of “ Apna Kaam Apna Khet”.

Considering the above facts mentioned in the factual report, I deem it just and proper to allow the anticipatory bail application of the accused-petitioners.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioners Jasoda Devi W/o Chouthmal, Kamla Devi W/o Ram Singh, Rajanti W/o Ramraj and Chiranji S/o Bajranga, Adopted Son Of Bheru, in connection with FIR No. 310/2016 registered at Police Station Bonli, District Sawaimadhopur, they shall be released on bail, provided they furnish personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or

indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioners shall not leave India without previous permission of the court.
