The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner Pravesh Kumar S/o Jorawar Singh. The petitioner has been arrested in connection with FIR No. 561/2023 registered at Police Station Vidhyadhar Nagar, District Jaipur for the offence(s) under Sections 384, 386 and 120-B of IPC.

Learned counsel for the petitioner submits that petitioner Pravesh Kumar has been falsely implicated in this case. Main allegation of extortion is against the accused Devraj and the alleged recovery of mobile containing the sim belonging to accused-petitioner was also recovered from the possession of accused Devraj from the central jail at Sever, Bharatpur and there is no direct allegation against the petitioner that he was involved

in the alleged crime. Counsel for the petitioner further submits that matter is triable by Magistrate and investigation/trial of the case will take considerable time and petitioner is in custody since long. Therefore, the benefit of grant of bail may be granted to the accused-petitioner.

Learned Public Prosecutor opposes the bail application.

Heard and perused the material available on record.

Considering the fact that recovery of mobile was made from the accused Devraj and allegation of threatening the complainant and extorting the money is also against the accused Devraj, without commenting anything on the merits of the case and considering the fact that petitioner is in custody since long and trial of the case will take time, therefore, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Pravesh Kumar S/o Jorawar Singh, in connection with FIR No. 561/2023 registered at Police Station Vidhyadhar Nagar, District Jaipur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the concerned SHO for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
