The present bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.463/2021 Registered at Police Station Pahadi, District Bharatpur for the offence(s) under Sections 3, 4, 5/8 of R.B.A. Act.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. They are behind the bars since 08.02.2024. Similarly situated co-accused Salim @ Sallam has been enlarged on bail by this Court vide order

dated 18.07.2022 in S.B. Criminal Misc. Bail Application No.10760/2022. Conclusion of trial may take long time. Hence, the petitioners may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the parties and taking into account the facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners Noormohammad S/o Dildar, Mustak S/o Noormohammad

and Sahun S/o Hanif be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they will appear before the trial court on all subsequent dates of hearing and as and when called upon to do so.
