The bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.50/2024 registered at Police Station Lalsoth, District Dausa for the offence(s) under Sections 419, 420 & 120-B of IPC and 66C & 66D of IT Act.

Learned counsel for the petitioners submits that the accusedpetitioners have falsely been implicated in this case. They further submit that section 419 IPC, 66C & 66D of the Information Technology (Amendment) Act, 2008 are bailable one. They further submits that there is no evidence indicating the fact that the accused-petitioners misrepresented themselves and cheated various persons through mobile. The matter is exclusively triable by Magistrate and accused-petitioners are in custody since long. Trial of the case may take considerable time, therefore the bail applications of the accused-petitioners may be allowed.

Learned GA-cum-AAG vehemently opposes the bail application.

Without expressing anything on the merits of the case and considering the fact that matter is exclusively triable by Magistrate and trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners namely: 1. Naresh Kumar S/o Shri Ram Meena, 2. Shyam Sundar S/o Shri Kajod Mal Sharma & 3. Sushil Kumar @ Bablu S/o Shri

Jagdish Prasad Meena in connection with FIR No.50/2024 registered at Police Station Lalsoth, District Dausa shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
