Apprehending his arrest in connection with FIR No.200/2024, registered at Police Station Kaithwada, District Deeg for the offence(s) under Sections 319(2), 318(4), 338, 336(3), 340(2), 317(2), 303(2), 61(2)(a) of BNS and Section 66-D of IT Act, the accused-petitioner has preferred this anticipatory bail application under Section 482 B.N.S.S.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the accused-petitioner was named by the other coaccused Waseem and the co-accused Waseem has already been enlarged on bail. There is no direct allegation against the accusedpetitioner that the accused-petitioner was inducing the person by creating fake email i.d. and advertisements and getting money from the persons induced. The accused-petitioner is ready and willing to co-operate with the investigation, the custodial interrogation of the petitioner is not required, therefore, the anticipatory bail application of the petitioner may be allowed.

Learned Public Prosecutor vehemently opposes the anticipatory bail application.

Considering the fact that the mobile phones were recovered from other co-accused, who have already been enlarged on bail. The accused-petitioner is ready and willing to co-operate with the investigation and the custodial interrogation of the petitioner is not required, without commenting anything on the merits of the case and considering the above facts, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner.

Accordingly, the anticipatory bail application under Section 482 B.N.S.S. is allowed. It is ordered that in the event of arrest of the petitioner- Aadil S/o Rafiq, in connection with FIR No.200/2024, registered at Police Station Kaithwada, District Deeg, he shall be enlarged on bail he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
