there against the petitioner that he was carrying gun but no allegation is there against him that he used that gun to cause the incident. Counsel submits that this fact is clear from the statements of the eye-witnesses Harnek Singh (PW-9) and Jaswant Singh (PW-10). Counsel submits that rest of the material witnesses namely Shivraj Singh (PW-1), Sukhraj Singh (PW-2), Amandeep Kaur (PW-3), Pradeep Kaur (PW-4), Rajveer Singh (PW-5) and Bhoop Singh (PW-6) have not supported the case of prosecution when their statements were recorded during the course of trial. Counsel submits that the prosecution has declared all of them hostile. Counsel submits that indulgence of bail has already been granted to the co-accused persons namely Permindar Singh @ Pintu, Arshdeep Singh @ Gabru, Kulwant Singh, Kuljeet Singh @ Rana, Bhupendra and Gurjant Singh @ Janta by different Co-ordinate Benches of this Court and the case of the present petitioner is at par with them. Counsel submits that the petitioner is in custody since the date of his arrest and trial will take its own time to conclude, therefore, indulgence of bail be granted to the petitioner.
