Heard learned counsel for the parties and perused the material available on record.

The petitioner has been arrested in connection with FIR No.66/2019 of Police Station Kalandri, District Sirohi for the offences punishable under Sections 8/15, 25 & 29 of the NDPS Act. He has preferred this bail application under Section 439 Cr.P.C (Bail Jump).

Counsel for the petitioner submits that the petitioner was granted regular bail under Section 439 Cr.P.C. vide order dated 18.09.2019 in S.B. Criminal Misc. Bail Application No.11132/2019 and is facing trial, but on dated 17.05.2023, he could not remain present before the trial court, thus, the court below forfeited his bail-bonds. The petitioner was in custody as reflected in the impugned judgment and has been produced before the learned trial court on production warrant on 27.12.2023 and since then he

is behind the bars. The petitioner is ready to submit his bail-bonds and shall continue to appear before the trial court on each and every date of hearing fixed by the trial court and shall not jump the bail again.

Learned Public Prosecutor opposes the bail application.

Having considered the totality of facts and circumstances of the case and the arguments advanced, this Court thinks it just and proper to enlarge the accused petitioner on bail. However, it is made clear that last opportunity is granted to the present petitioner in the case and if he commits default in appearing before the learned trial court on the date fixed and will jump the bail, no leniency will be granted to him in the future.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner - Anil S/o Asu Ram shall be released on bail in connection with FIR No.66/2019 of Police Station Kalandri, District Sirohi provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
