The instant bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner in connection with FIR No.100/2024 registered at Police Station Masalpur, District Karauli for offences under Sections 332, 353, 143, 307 & 379 IPC and Section 4/21 of the MMDR Act.

Learned counsel for the petitioner submits that false allegations of using a firearm have been levelled against the accused-petitioner. However, there is no gun shot injury sustained by any member of the complainant side. Learned counsel further submits that all the other co-accused persons have already been enlarged on bail by the learned Court below. Learned counsel also submits that the petitioner is in custody since 03.08.2024, therefore, he may be released on bail.

Learned Public Prosecutor vehemently opposed the bail application.

Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material available on record.

Having considered the allegations levelled against the petitioner as well as the fact that there is no gun shot injury sustained by any member of the complainant party and also the other co-accuseds have already been enlarged on bail, this Court without expressing any opinion on the merits/demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 of the B.N.S.S. is allowed and it is ordered that the accused-petitioner named above in connection with FIR No.100/2024 registered at Police Station Masalpur, District Karauli shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
