The present 3rd bail application has been filed by the petitioner under Section 483 BNSS in connection with FIR No. 1034/2022 registered at Police Station Beawer City, District Ajmer for the offence(s) under Section 302 IPC (later on offence under Sections 450, 302 and 120-B IPC were found to have been made out).

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 17.11.2022. Learned counsel further submits that the petitioner has no concerned with the alleged offence. Eye-witness PW-10 Neera Khan has not named the petitioner in her evidence. Co-accused Laxman Singh and Sukhdev @ Kuka have been enlarged on bail by the Co-ordinate Benches of this Court vide orders dated 28.11.2023 and 12.09.2023 respectively. Learned

counsel for the petitioner further submits that out of 52 witnesses, statements of only 12 witnesses have been recorded by the trial Court till today. Conclusion of trial may take long time. So, the petitioner be enlarged on bail.

Learned Addl.G.A. has opposed the arguments advanced by counsel for the petitioner.

I have considered the arguments advanced by counsel for the petitioner as well as learned Addl.G.A.

First bail application filed by the petitioner was dismissed on merits by this Court vide order dated 16.04.2024. After that, there is no change in the facts and circumstances of the case. Allegation against the petitioner is that the petitioner and co-accused hatched a conspiracy to commit murder of Hajrat Ali. As per CCTV footage, the petitioner and other co-accused were present at the time of incident. So, looking to the gravity of offence, I do not consider it a fit case to enlarge the petitioner on bail.

The 3rd bail application is accordingly dismissed.
