Learned counsel for the appellant does not want to press the instant criminal appeal at this stage but, he seeks leave of the Court to file a fresh appeal after the statements of the eye witness Radha are recorded.
Accordingly, this present criminal appeal is dismissed as not pressed with liberty prayed for. It is expected from the trial court that the statements of the eye witness Radha will be recorded on priority basis.
