For the reasons mentioned therein, the application is allowed. Delay in filing the restoration application is condoned.

This application is filed for restoration of the appeal (D.B. Civil Misc. Appeal No.3539/2022). The appeal was dismissed for non-compliance of the order dated 19.08.2023 passed by this Court and the order dated 20.11.2023 passed by the Registrar (Judicial).

For the reasons mentioned therein, the application is allowed and D.B. Civil Misc. Appeal No.3539/2022 be restored to its original number, subject to filing of required PF & notices upon unserved respondent(s) within three weeks. In case of failure to do the needful, the restoration order passed today shall stand revoked without reference to the Court.

If required PF & notices are filed within time, let fresh notices be issued to the unserved respondent(s), returnable on 10.01.2025.
