Learned counsel for the appellant-plaintiff submits that the application under Order 39 Rule 1 and 2 CPC in the suit filed for specific performance of the agreement against the respondent No.1 to 4 has been dismissed by the learned trial Court vide order dated 06.08.2016. The appellant being aggrieved of the same has preferred the present appeal before this Court.

A Co-ordinate Bench of this Court vide order dated 07.10.2016 had granted interim order while directing the respondent No.5 to not alienate the suit property until further orders.

Learned counsel for the appellant makes a limited prayer that the interim order dated 07.10.2016 may be made absolute till final disposal of the suit.

Thus, in view of the limited submissions made, this Court deems it appropriate to confirm the interim order dated 07.10.2016 passed by this Court till final disposal of the Civil Original Suit No.89/2011 (Kashmir Singh Vs. Vimla Devi & Ors.) pending before learned Additional District Judge, Sri Karanpur, District Sri Ganganagar. Stay application stands disposed of.

With the aforesaid directions, the present Misc. Appeal is disposed of.
