Matter has come up on an application bearing Inward No.2/2024 dt.06.09.2024 filed by the appellant praying therein for withdrawal of the appeal as the parties have amicably settled their dispute.
Learned counsel appearing for the appellant contends that during pendency of the appeal both the parties have amicably settled their dispute & in pursuance of that settlement the amount of sale consideration has been paid by the respondent and now nothing remains in this appeal. Counsel further contends that in the interest of justice, the amount of the Court Fee paid in respect of this appeal by the appellant may be directed to be refunded.
Heard. Perused.
Considering the contents of the aforesaid application & the submissions made at bar, the application is allowed and the present appeal is hereby dismissed as withdrawn.
