Matter has come up on Writ Misc. Application No.61/2023 filed by petitioner for clarification of the order dated 29.03.2023 to the extent of granting liberty to petitioner to file afresh writ petition.

It has been submitted by learned counsel for petitioner that SBCWP No.4269/2023 was filed by petitioner to consider the candidature of petitioner on the post of Junior Assistant/Commercial Assistant-II against the available vacancies in the other company like RVPNL and JVVNL pursuant to advertisement dated 22.02.2021, however, in order to add new pleadings and documents, the writ petition was sought to be withdrawn with liberty to file afresh. This Court was kind enough to allow to withdraw the writ petition vide order dated 29.03.2023, but in the order, the liberty to petitioner for file afresh writ petition has not indicated.

It has been submitted that after withdrawal of the writ petition on 29.03.2023, petitioner has filed fresh writ petition bearing No.5736/2023 with updated pleadings and additional documents, to claim the similar relief.

Having considered the aforesaid contentions of learned counsel for petitioner for clarification to grant liberty to petitioner for filing afresh writ petition, this Court deems it just and proper to observe that withdrawal of SBCWP No.4269/2023 by the petitioner shall not preclude the petitioner to pursue the SBCWP No.5736/2023 on merits.

With aforesaid observations, the SB Writ Misc. Application No.61/2023 stands disposed of.
