The matter comes up on for consideration the instant application preferred on behalf of the State seeking modification/correction in the order dated 12.07.2022 passed by this Court in D.B. Civil Writ Petition No.2786/2020 (Suo Moto Vs. State of Rajasthan & Ors.).

Mr. Joshi, learned AAG has submitted that this Court vide order dated 12.07.2022 while disposing of the writ petition has observed that in the additional affidavit filed on behalf of the Officer-in-Charge on 05.07.2022, details of measures put in place for curbing the menace and to control the activities under the NDPS Act had been set out and as per the same, a special cell comprising of one Sub-Inspector, two Head-Constables and four Constables under the supervision of the Additional Superintendent of Police is proposed to be established in all Police Stations.

Mr. Joshi, learned AAG has further submitted that as a matter of fact, proposal regarding establishment of a special cell comprising of one Sub-Inspector, two Head-Constables and four Constables under the supervision of the Additional Superintendent of Police was for all the District Headquarters and not in all the police stations of the State. He, thus, prays that a clarification in this regard be made in the order dated 12.07.2022.

Taking into consideration the above facts and circumstances of the case, the instant application is allowed and it is directed that the order dated 12.07.2022 passed by this Court in D.B. Civil Writ Petition No.2786/2020 is modified and now the relevant portion of the order shall be read as under :

“a special cell comprising of one Sub-Inspector, two Head-Constables and four Constables under the supervision of Additional Superintendent of Police is proposed to be established for all the District Headquarters of the State.”
